Introduction to Anarchist Jurisprudence and Law
The anarchist system of jurisprudence is a common law system with feud and realpolitik as the source of law.
In the anarchist system, legal precedent (jus cogens) is discovered through the repetitive and reciprocal engagement of rivalrous actors.
When conducted in the formal setting, it is called common law. When legal precedent is recorded, we call it case law (restatements, responsa, etc). When expert jurists are convened to contribute to case law before a dispute occurs, we call this the juriconsult(juriconsultation).
In the informal setting, it is called feud law (aka vendetta, blood law, adversarial law), which serves as the ultimate source of law. Feud systems have contributed precedent to judicial systems: March Law to Anglo-American common law, Bedouin precedent to Islamic courts, and California mining law. Mutual threat and realpolitik rests at the source of law.
There can be no rule of law until we are all equal before it. The only legitimate social contract is discovered through repetitive, reciprocal engagement among peers - not popular sovereignty or legislative decree.
